Due Diligence When Buying Property in Ibiza

In a market without title insurance, the checks your lawyer runs are the protection you have. Here is what they cover.

Between the reservation and the contrato de arras, your lawyer examines the property from every legal angle, and nothing binding is signed until the findings are in. The core checks are consistent from purchase to purchase.

  • Title at the land registry: that the seller owns what is being sold, and that boundaries and described surfaces match reality.
  • Charges and debts: mortgages, embargoes, unpaid taxes or community fees that could follow the property.
  • Planning legality and licences: that the house was built with permission and holds its cédula de habitabilidad, the certificate of habitability.
  • Extensions and pools: on Ibiza, later additions are common and not always legalised, and your lawyer confirms their status.
  • Rural land: fincas on suelo rústico carry specific planning restrictions that deserve their own review.
  • ETV status: if rental income matters to you, whether the property holds a tourist rental licence, which is property-specific and cannot be assumed.
  • Community statutes: where the property belongs to a community, the rules and any restrictions on use.

Why this matters more here than at home

In a US purchase, title insurance and an escrow company stand behind the transaction: if something was missed, there is a policy to claim against. Spain works differently. The notary certifies the deed and the land registry records title, and both are reliable, but neither replaces the investigative work of a lawyer acting only for you. What is checked before signing is your protection, and on an island of older houses, generous extensions and rural land, there is more to check than in a new American subdivision. This is why Hoy Hoy Ibiza insists every client engage an independent English-speaking lawyer, and why we build due diligence time into every offer we negotiate. With power of attorney in place, the entire review, and the signing that follows it, can be completed while you remain in the United States.
