USA Buyer FAQ: Buying Property in Ibiza as an American

Buying a home in Ibiza from the United States naturally creates questions.

Can Americans legally buy property in Spain? Do you need residency? Can you get a mortgage? Do you need a Spanish bank account? Can you complete the purchase remotely? What happens with taxes? Can you rent the property when you are not using it? And who looks after the home when you return to the United States?

Below are answers to the questions we hear most often from American buyers considering property in Ibiza.

For subjects requiring legal, tax, immigration or financial advice, Hoy Hoy Ibiza Real Estate can help connect you with appropriately qualified independent professionals.

Frequently Asked Questions

Yes. U.S. citizens can buy property in Ibiza and elsewhere in Spain.

You do not need to be a Spanish or EU citizen simply to purchase Spanish real estate. Buying a property, however, does not itself give you Spanish residency rights.

American buyers should therefore treat property ownership and immigration or residency status as separate matters.

HOW TO BUY PROPERTY IN IBIZA FROM THE USA

No. You can purchase property in Ibiza as a non-resident.

Many international owners use their Ibiza property as a second home while maintaining their primary residence elsewhere.

If you intend to spend significant periods in Spain, questions around immigration status, tax residence and permitted length of stay should be discussed separately with the appropriate qualified professionals.

No. Purchasing property in Spain does not automatically provide Spanish residency.

Spain ended the real-estate investment route under its investor residence regime in 2025. Property ownership and the right to reside in Spain should therefore be considered separately. Spain's official consular information confirms that the investor visa provisions were abolished with effect from 3 April 2025.

If living in Ibiza rather than simply owning a second home is part of your plan, obtain current immigration advice based on your individual circumstances.

Yes. An NIE, Número de Identidad de Extranjero, is an identification number used for foreigners in Spain and is required for key procedures associated with a Spanish property acquisition.

It is important to understand that an NIE is an identification number. It is not the same thing as becoming a Spanish resident.

Your Spanish lawyer can advise on the appropriate process and timing for obtaining it.

A Spanish bank account is commonly useful for owning property in Spain, particularly for ongoing payments, utilities and local expenses, but buyers should avoid treating every banking arrangement as identical.

The way purchase funds are transferred and the documentation required can depend on the transaction, bank and source of funds.

For American buyers, we recommend discussing the banking and funds-transfer structure early with your independent lawyer, bank and, where appropriate, financial or tax adviser rather than waiting until completion is approaching.

Potentially, yes. Spanish lenders can provide mortgages to non-resident buyers, including U.S. citizens, subject to the lender's criteria and the buyer's financial circumstances.

The amount a bank is prepared to finance, interest rate, documentation and affordability requirements vary.

If financing forms part of your purchase, it is better to investigate it before making an offer. That allows your property search to be built around a realistic acquisition budget rather than discovering financing constraints after finding the property.

Hoy Hoy Ibiza can help connect buyers with relevant mortgage or finance professionals where required.

Yes. In fact, we recommend it.

Through our Buyer Representation service, Hoy Hoy Ibiza Real Estate can begin your search while you are still in the United States.

We first establish your objectives, budget, preferred property type, lifestyle and location requirements. We can then research relevant opportunities, communicate with agencies and owners and explore suitable public, private and off-market opportunities.

The purpose is to narrow the market before you travel.

By the time you arrive in Ibiza, you should have a focused property search rather than starting from zero.

EXPLORE BUYER REPRESENTATION

No. When Hoy Hoy Ibiza Real Estate is representing you as a buyer, your search is not limited to properties listed directly by us.

We can consider our own opportunities, cooperate with other professional real estate agencies and use our wider Ibiza network to identify relevant properties.

That is an important distinction in our approach to buyer representation.

We begin with what you are looking for, not simply what we have available to sell.

Off-market and privately marketed opportunities can form part of our search when suitable properties are available.

Not every Ibiza property is publicly advertised. Some owners prefer a more discreet sales process, and opportunities can circulate through professional and local networks.

However, “off-market” should not automatically be interpreted as “better.”

A privately marketed property still needs to be assessed critically for price, suitability, condition, documentation and legal position.

Our objective is to find the right property whether it is publicly advertised or privately introduced.

Yes. Remote property previews and video calls can be used during the early stages of a search.

This can help eliminate properties that do not justify a transatlantic trip and allow us to investigate promising opportunities further before you travel.

For a major purchase, however, remote viewing should not replace appropriate property-level investigation and independent professional due diligence.

Where possible, experiencing the property and its location personally remains valuable.

Yes. We can help facilitate your Ibiza property trip from arrival to departure.

Before you leave the United States, Hoy Hoy Ibiza Real Estate can prepare your property search and viewing itinerary.

Through Hoy Hoy Ibiza and our local network, we can also help coordinate the wider trip depending on your requirements, including accommodation, airport transfers, private drivers, restaurants and other local services.

If useful, we can help coordinate introductions or appointments with independent lawyers, tax advisers, finance specialists, architects and other professionals while you are on the island.

The objective is that your property search is already organised when you arrive.

PLAN MY IBIZA PROPERTY TRIP

United Airlines has announced a seasonal nonstop service between Newark Liberty International Airport (EWR) and Ibiza Airport (IBZ) beginning 31 May 2027.

The announced service is planned four times weekly using the Airbus A321XLR and remains subject to government approval. United describes the route as making it the only U.S. airline with nonstop service to Ibiza.

Until the route begins, most American travellers reach Ibiza with a connection through a European airport.

Because airline schedules change, always verify current service directly with the airline before travelling.

GETTING TO IBIZA FROM THE USA

Start with your lifestyle rather than the listings.

Ibiza Town, Marina Botafoch, Talamanca, Sant Josep, Es Cubells, the west coast, Santa Gertrudis, northern Ibiza and Santa Eulària offer very different ownership experiences.

Think about how you want to live: sea or countryside, privacy or convenience, villa or apartment, family life or entertaining, proximity to Ibiza Town or distance from it.

Our buyer representation team can help translate those requirements into suitable locations before narrowing the property search.

WHERE TO BUY IN IBIZA

There is no single guaranteed timeframe.

The timing depends on the property, negotiations, legal due diligence, financing, documentation, the parties involved and the structure of the transaction.

A straightforward acquisition with complete documentation may progress considerably differently from a property requiring additional legal, planning, financing or technical investigation.

We recommend allowing the due diligence process to determine the timing rather than rushing an acquisition simply to meet an arbitrary completion date.

We strongly recommend that an international buyer appoint an independent Spanish lawyer experienced in property transactions.

Your lawyer should represent your legal interests independently and review the relevant property documentation, contracts and legal position.

Hoy Hoy Ibiza Real Estate coordinates the real estate and commercial side of the acquisition but does not replace independent legal advice.

If you do not already have a lawyer in Ibiza, we can help connect you with relevant independent professionals.

The appropriate due diligence depends on the individual property.

Your independent lawyer may need to investigate matters including ownership, registered charges, property descriptions, planning and licensing issues, community matters and other documentation relevant to the transaction.

Technical investigation may also be appropriate depending on the property.

This is particularly important in Ibiza, where rural properties, older homes, extensions, pools and other structures can require careful property-specific investigation.

Never assume that something is legally compliant simply because it physically exists.

A Nota Simple is an informational Land Registry extract that provides important information about a registered property, including registered ownership and certain registered rights, charges or restrictions.

It is an important document in the acquisition process, but it is not a substitute for complete legal due diligence.

Your independent lawyer should determine what documentation and checks are appropriate for the property you are considering.

An arras agreement is a private agreement commonly used during Spanish property transactions in which the parties set out terms relating to the proposed purchase and a deposit.

The legal consequences depend on the specific type of agreement and its wording.

You may hear the simplified explanation that a buyer who withdraws loses the deposit and a seller who withdraws repays double. That can apply to certain arrangements, but it should not be treated as a universal rule for every contract described as “arras.”

Have your independent lawyer review the agreement and explain its consequences before signing or transferring significant funds.

Deposit structures vary by transaction.

A 10% amount is frequently associated with private purchase or arras arrangements in Spain, but buyers should not assume that every transaction follows exactly the same structure.

The amount, timing, conditions and legal consequences should be established in the documentation and reviewed by your lawyer.

The purchase price is not the total acquisition cost.

Depending on the property and transaction, additional costs can include taxes, notary and registry costs, legal fees, financing-related costs and other professional expenses.

The applicable tax treatment can differ between new-build and resale property and can change over time.

For that reason, we recommend obtaining a current transaction-specific cost calculation from your independent lawyer or tax adviser before making the final acquisition decision rather than relying on a generic percentage published online.

In many transactions, substantial parts of the process can be handled remotely.

With the appropriate arrangements, your lawyer and other professionals may be able to handle various procedures while you are in the United States.

A Spanish power of attorney can also be used in appropriate circumstances to authorise a representative to perform specified actions on your behalf.

The precise form, powers and execution requirements should be determined by your Spanish lawyer.

This can make ownership in Ibiza considerably more practical for American buyers who cannot repeatedly travel to Spain during the acquisition.

Potentially, yes.

Depending on how the transaction has been structured and the powers you have granted, completion may be possible through an authorised representative.

Your lawyer should advise whether this is appropriate and ensure that the required documentation has been correctly prepared.

This is one reason we recommend establishing your independent legal representation early in the process.

International property purchases require careful coordination of funds.

Your bank, Spanish lawyer and any relevant financial or foreign-exchange professional should explain the transfer process, timing and documentation required for your transaction.

Spanish banks and professionals involved in the transaction may also require documentation regarding the source of funds as part of applicable compliance procedures.

Do not leave this until the final days before completion.

For an American buyer, planning the movement of funds should form part of the acquisition preparation.

Potentially, yes. Spanish property ownership can create Spanish tax obligations even when you remain resident in the United States.

Spain has specific tax rules for non-resident property owners, including Non-Resident Income Tax provisions. Individual circumstances can also raise other Spanish tax considerations depending on ownership, value, use and other factors.

American citizens may simultaneously have U.S. tax or reporting obligations.

Cross-border tax matters should therefore be discussed with appropriately qualified Spanish and U.S. advisers.

OWNING A HOME IN IBIZA

Potentially, yes.

Spain has specific tax rules applicable to non-resident owners of Spanish real estate, including circumstances where the property is held for personal use rather than rented.

The Spanish Tax Agency provides specific information and procedures for non-resident property owners, including the Non-Resident Income Tax system.

The actual calculation and filing obligations depend on your circumstances and should be confirmed with a qualified adviser.

Do not assume that purchasing a property automatically gives you the right to offer it as short-term tourist accommodation.

Ibiza and the Balearic Islands have specific rules governing tourist accommodation, and the legal position depends on the property and applicable regulations.

If rental potential is important to your purchase decision, tell us before we begin the search.

The relevant legal and licensing position should be independently verified before you buy rather than assuming that future holiday-rental income will be available.

This is where local property management becomes important.

Hoy Hoy Ibiza Real Estate's Property Management services can support owners with the practical care and coordination of their Ibiza homes.

Depending on the service required, this can include property inspections, key holding, maintenance coordination, cleaning coordination, preparation before your arrival and project coordination.

Through the wider Hoy Hoy Ibiza network, owners can also access relevant professionals and services for gardens, pools, security, construction, interiors and other property requirements.

You can own the property without trying to manage every practical issue from thousands of miles away.

DISCOVER PROPERTY MANAGEMENT

Yes.

Depending on your requirements, cleaning and other practical property services can be coordinated before your arrival.

If work has taken place while you were away, the property can also be checked and prepared ahead of your return.

The idea is that you arrive at your Ibiza home to enjoy it rather than spending the first days organising it.

Yes. This is an important part of the Hoy Hoy Ibiza concept.

A property owner eventually needs much more than a real estate agent.

Through the wider Hoy Hoy Ibiza platform and local network, we can help connect owners with services across the island, from lawyers, tax professionals, architects, interior designers and property services to private drivers, restaurants, schools, healthcare, sports, boating and other aspects of life in Ibiza.

For American buyers, this means the network you build during the purchase can continue after you receive the keys.

Our real estate team works with national and international buyers across Ibiza.

Buyer representation is handled by members of our local team, including Johnny Melten, Barry Lapré and Giselle López Costa, supported by the wider Hoy Hoy Ibiza Real Estate organisation and professional network.

We remain focused on the property and commercial side of your acquisition while independent lawyers, tax advisers and other qualified specialists advise within their own professional areas.
